23-28.6-21. Sprinklers required.

(a) All new and existing places of assembly shall be completely protected by an approved system of automatic sprinklers installed and maintained in accordance with N.F.P.A. Standard 13, 2002 Edition and its related standards pursuant to the schedule outlined in subsection (d).

(b) The requirements of subsection (a) shall not apply to:

(i) Any place of assembly with an occupancy load of fifty (50) to three hundred (300) people of less concentrated use, exclusively calculated at fifteen (15) square feet per person;

(ii) Any place of assembly with an occupancy load of fifty (50) to three hundred (300) people of concentrated use not classified as a nightclub;

(iii) Any place of assembly with an occupancy load of fifty (50) to three hundred (300) people of concentrated use, classified as a nightclub with a posted maximum occupancy of less than one hundred fifty (150) people;

Rhode Island Fire and Safety Update:

The standards council of the National Fire Protection Association in August issued two key safety codes that will require fire sprinklers in all nursing homes, in new construction of one- and two-family dwellings, and in all new construction of nightclubs and like facilities, as well as for existing nightclubs and like facilities with capacities over 100.

The code provision for family dwellings is a “milestone” in fire protection, said NFPA President James M. Shannon. “It is a significant step in reducing the rate of fire death and injury in the place where people are at most risk for fire - their own homes.”

The provisions apply to the 2006 editions of NFPA 101, Life Safety Code, and NFPA 5000, Building Construction and Safety Code, and went into effect on August 18.

The nightclub provision mandates sprinklers for new facilities, generally applicable to more than 50-occupant capacities. The provision was added to NFPA 101 and NFPA 5000 after a tentative interim amendment had been approved by the standards council in 2003.

Failure to file timely affidavits and reports will jeopardize the ability of the owner (or the owner’s successor) to claim a hardship extension of time to comply with the July 1, 2018 deadline.
